A sex offender who has served his prison sentence was released Tuesday night after a judge ruled against prosecutors who wanted to keep him in a mental hospital, prosecutors said. Davison was released from prison in 2000, but was confined to Coalinga State Mental Hospital in 2005 after he violated parole and the District Attorney's Office succeeded in having him designated as a sexually violent predator (SVP). Under the SVP law, two-time sex offenders who are diagnosed with a mental disorder and who are found likely to re-offend by a jury are confined to a mental care facility.In 2008, state SVP evaluators decided that Davison did not have a current mental disorder, meaning he could no longer be required to remain in the mental hospital, prosecutors said. {Ed: even murderers do not get indefinite sentences.] (11/11/09)
